Omnilex summary

The Federal Supreme Court did not enter into the criminal complaint against the Zurich authorities’ refusal to prosecute. It held that the complainant, as an injured party seeking the conviction of the company, lacked standing under Art. 81 BGG because criminal prosecution is generally reserved to the state and he was neither a private prosecutor nor a victim. Court costs of CHF 800 were imposed on him.

Omnilex headnote

Art. 81 Abs. 1 lit. b BGG; standing of an injured party to challenge a non-prosecution decision: a complainant who merely seeks the conviction of the accused lacks a legally protected interest, since the criminal claim belongs in principle to the state. Standing exists only where the conditions of the special statutory categories are met, in particular as private prosecutor or victim; otherwise the complaint is manifestly inadmissible under Art. 108 BGG. Cost allocation follows the outcome under Art. 66 Abs. 1 BGG.

Urteil vom 29. April 2007
Strafrechtliche Abteilung

Besetzung
Bundesrichter Schneider, Präsident,
Gerichtsschreiberin Arquint Hill.

Parteien
X._________,
Beschwerdeführer,

gegen

Oberstaatsanwaltschaft des Kantons Zürich, Postfach, 8090 Zürich.

Gegenstand

Januar 2007.

Das Präsidium zieht in Erwägung:

1.

Extracted reasoning

A request aimed at obtaining a conviction of the accused does not confer standing on an injured person absent special status under Art. 81 BGG.

Key legal question

Allocation of federal court costs

Extracted holding

The court costs were imposed on the complainant.

Extracted reasoning

As the complaint was inadmissible, the costs followed the outcome.
