Omnilex summary

The Federal Supreme Court held that it could not revisit the advance-cost issue because it had already been finally decided in a prior federal judgment. The appeal against the Solothurn appellate chamber’s non-entry decision was therefore inadmissible under Art. 108 BGG. The appellant’s request for legal aid was refused because the appeal had no prospects of success. Court costs of CHF 500 were imposed on the appellant, adjusted to his financial situation.

Omnilex headnote

Art. 108 BGG; res judicata of a previously finally decided issue bars renewed review in summary procedure. Where the appeal merely seeks reconsideration of a matter already decided by a final federal judgment, the Court will not enter into the matter. Legal aid under Art. 64 BGG is denied if the legal remedy lacks prospects of success; the party’s financial circumstances are relevant only for fixing the court fee under Art. 65 Abs. 2 BGG. Costs are generally borne by the losing party under Art. 66 Abs. 1 BGG; vexatious conduct may weigh against any waiver.

Urteil vom 2. August 2010
Strafrechtliche Abteilung

Besetzung
Bundesrichter Favre, Präsident,
Gerichtsschreiber C. Monn.

Verfahrensbeteiligte
X.________,
Beschwerdeführer,

gegen

Staatsanwaltschaft des Kantons Solothurn, Franziskanerhof, Barfüssergasse 28, 4502 Solothurn,
Beschwerdegegnerin.

Gegenstand

Key legal question

Whether the Federal Supreme Court could revisit the advance-cost question decided in a prior final judgment.

Extracted holding

The issue could no longer be reopened because it had already been finally decided in judgment 1B_132/2010.

Extracted reasoning

The appellant merely challenged the advance costs again; the matter was already res judicata at federal level, so no further review was possible.

Key legal question

Whether the appeal was admissible under Art. 108 BGG.

Extracted holding

The appeal was not entered into in summary procedure.

Extracted reasoning

Because the decisive complaint was already finally resolved, the appeal was inadmissible and could be rejected without full proceedings.

Key legal question

Whether legal aid should be granted.

Extracted holding

Legal aid was refused because the appeal had no prospects of success.

Extracted reasoning

The request failed since the submissions were manifestly unsuccessful; the appellant's financial situation only influenced the court fee.

Key legal question

How court costs should be allocated.

Extracted holding

Court costs of CHF 500 were imposed on the appellant, taking his financial situation into account.

Extracted reasoning

Costs had to be charged to the losing party; no waiver was justified in view of the vexatious manner of litigation.
