Omnilex summary

The defendant X.________ challenged a judgment of the Bern Cantonal Court in a criminal matter but failed to enclose the appealed decision. After the Federal Supreme Court ordered him to remedy the defect by 29 October 2012, the order was deemed served because he did not collect the postal delivery. Since the missing judgment was still not filed within the deadline, the Criminal Law Division, sitting by single judge, declared the complaint inadmissible under Art. 108 BGG. The court waived court costs.

Omnilex headnote

Art. 108 BGG; non-entry due to failure to cure an inadmissibility defect. Where the Federal Supreme Court orders a party to remedy a formal defect by filing the missing document within a set deadline, the order is deemed served if the party fails to collect the postal delivery and must ensure that judicial mail reaches them. If the defect is not cured in time, the court does not enter into the appeal without examining the merits; costs may be waived.

Key legal question

Whether the criminal complaint could be entered into despite the missing appealed judgment.

Extracted holding

No. Because the defect was not cured within the time limit, the complaint was not entertained under Art. 108 BGG.

Extracted reasoning

The Federal Supreme Court ordered the appellant to submit the missing decision by 29 October 2012. The order was deemed served when the appellant failed to collect it from the post; he had the duty to ensure receipt of court mail. As the judgment still had not been filed, the complaint had to be dismissed as non-admissible without examination.

Key legal question

Whether court costs should be imposed.

Extracted holding

No court costs were charged.

Extracted reasoning

The court expressly waived costs.
