Omnilex summary

The Federal Supreme Court dealt with an appeal against a cantonal decision refusing to enter into a reopening request because the applicant had not paid the required cost advance. In his federal appeal, the appellant did not address this decisive ground. The court held that the filing failed to meet the reasoning requirements of the Federal Supreme Court Act and therefore did not examine the merits, including the question of who was the responsible driver. The appeal was not entered into, and court costs of CHF 800 were imposed on the appellant.

Urteil vom 23. September 2008
Strafrechtliche Abteilung

Besetzung
Bundesrichter Schneider, Präsident,
Gerichtsschreiber Monn.

Parteien
X.________,
Beschwerdeführer,

gegen

Staatsanwaltschaft des Kantons Solothurn, Franziskanerhof, Barfüssergasse 28,
4502 Solothurn, Beschwerdegegnerin.

Gegenstand
Wiederaufnahmebegehren,

Beschwerde gegen den Beschluss des Obergerichts
des Kantons Solothurn, Strafkammer, vom 15. Mai 2008.

Der Präsident zieht in Erwägung:

1.
In seiner Beschwerde vom 10.

Lausanne, 23. September 2008

Key legal question

Whether the appeal met the Federal Supreme Court's reasoning requirements despite not addressing the cost-advance ground for the lower court's non-entry decision.

Extracted holding

The appeal did not satisfy the reasoning requirements and could not be examined further.

Extracted reasoning

The appellant failed to discuss the decisive ground of the challenged decision, namely non-payment of the cost advance. The submission therefore did not comply with Art. 42(2) and Art. 106(2) BGG, so the court could not consider the merits.

Key legal question

Allocation of court costs

Extracted holding

Court costs were imposed on the appellant.

Extracted reasoning

As the appeal was not entertained, the costs were charged to the appellant under the ordinary cost rule.
