Omnilex summary

The Federal Supreme Court treated the appellant's filing as a criminal appeal, since he did not react to the court's notice about that qualification. It then held that the appeal did not engage with the reasons of the cantonal judgment and therefore failed the federal reasoning requirement; in addition, it was filed late. The court therefore issued a non-entry decision in summary procedure and charged the appellant court costs of CHF 800.

Omnilex headnote

Art. 42 Abs. 2 BGG, Art. 100 Abs. 1 BGG, Art. 44 Abs. 1 BGG, Art. 108 BGG; requirements for admissibility of a criminal appeal. A submission that does not deal, in a substantiated manner, with the reasons of the challenged decision fails the federal reasoning requirement and is inadmissible. Independently, an appeal filed out of time is likewise inadmissible. Where these defects are manifest, the court may dispose of the matter by non-entry in summary procedure under Art. 108 BGG. Court costs are borne by the unsuccessful appellant under Art. 66 Abs. 1 BGG.

Urteil vom 24. November 2007
Strafrechtliche Abteilung

Besetzung
Bundesrichter Schneider, Präsident,
Gerichtsschreiberin Arquint Hill.

Parteien
X.________,
Beschwerdeführer,

gegen

Staatsanwaltschaft des Kantons Aargau, Frey-Herosé-Strasse 12, Wielandhaus, 5001 Aarau,
Beschwerdegegnerin.

Gegenstand
Geringfügiger Diebstahl,

Beschwerde gegen das Urteil des Obergerichts des Kantons Aargau, Strafgericht, 2. Kammer, vom 25. Juli 2007.

Der Präsident zieht in Erwägung:
1.

3.
Dieses Urteil wird den Parteien und dem Obergericht des Kantons Aargau, Strafgericht, 2. Kammer, schriftlich mitgeteilt.

Extracted by Omnilex

Key legal question

Whether the filing should be treated as a criminal appeal under the Federal Supreme Court Act.

Extracted holding

The filing was treated as a criminal appeal because the appellant did not object to that qualification after notice from the court.

Extracted reasoning

The court informed the appellant that the submission would be considered a criminal appeal absent a response by the stated deadline; no response was received.

Key legal question

Whether the appeal satisfied the Federal Supreme Court's reasoning and timeliness requirements.

Extracted holding

It did not satisfy the reasoning requirement and was also late.

Extracted reasoning

The submission did not address the reasoning of the challenged judgment and therefore failed Art. 42(2) BGG; moreover, it was filed out of time under Art. 100(1) and Art. 44(1) BGG.

Key legal question

Whether the court could enter into the appeal in summary procedure.

Extracted holding

No entry was possible in summary procedure.

Extracted reasoning

Because the appeal was manifestly insufficiently reasoned and in any event late, non-entry was appropriate under Art. 108 BGG.
