Omnilex summary

X. appealed to the Federal Supreme Court against an Aargau cantonal decision that had upheld a non-entry order on his criminal complaint against an official. The court held that he lacked standing as an injured person, that his allegations of procedural-guarantee violations were insufficiently reasoned under Art. 106(2) BGG, and that a later recusal request could not be considered in this appeal. The appeal was not entered into. The request for free legal aid was denied because the appeal was hopeless and indigence was not alleged. Court costs of CHF 800 were charged to the appellant.

Omnilex headnote

Art. 108 BGG; Art. 106 Abs. 2 BGG; Art. 64 BGG: An appeal is inadmissible where the appellant lacks standing and the submissions do not meet the federal substantiation requirements. Alleged procedural-guarantee violations must be specifically reasoned; a mere assertion is insufficient. Review is confined to the challenged decision and cannot extend to later procedural motions such as a subsequently filed recusal request. Free legal assistance is refused where the appeal has no prospects of success and financial need is not shown. Court costs are borne by the unsuccessful appellant under Art. 66 Abs. 1 BGG.

Urteil vom 4. Dezember 2007
Strafrechtliche Abteilung

Besetzung
Bundesrichter Schneider, Präsident,
Gerichtsschreiber Monn.

Parteien
X.________,
Beschwerdeführer,

gegen

Staatsanwaltschaft des Kantons Aargau, Frey-Herosé-Strasse 12, Wielandhaus, 5001 Aarau,
Beschwerdegegnerin.

Gegenstand

Lausanne, 4. Dezember 2007

Extracted by Omnilex

Key legal question

Whether the appellant was entitled to challenge the cantonal decision as an injured person

Extracted holding

He lacked standing to appeal.

Extracted reasoning

The court referred to an earlier judgment and held that the appellant, as an injured person, was not legitimized to complain in this matter.

Key legal question

Whether the appeal met the federal pleading requirements for alleged violations of procedural guarantees

Extracted holding

No. The complaint did not substantiate any procedural-guarantee violation.

Extracted reasoning

The appellant merely invoked procedural guarantees without explaining them, so the appeal failed to satisfy Art. 106(2) BGG.

Key legal question

Whether the court could consider a recusal request filed after the challenged decision

Extracted holding

No. A later recusal request could not be examined in proceedings concerning the earlier decision.

Extracted reasoning

The appeal concerned a decision of 22 October 2007, whereas the recusal request dated 12 November 2007 was outside the scope of review.

Key legal question

Whether the request for free legal aid should be granted

Extracted holding

It was denied because the appeal had no prospects of success and indigence was not shown.

Extracted reasoning

The legal claims were hopeless and the appellant did not assert financial need.
