Omnilex summary

The Federal Supreme Court held that the appellant's filing did not engage with the decisive question whether the cost-advance request violated federal law, so it failed to satisfy the statutory reasoning requirements. The court therefore did not enter into the complaint under the summary non-entry procedure. Court costs of CHF 800 were charged to the appellant.

Omnilex headnote

Art. 42 Abs. 2, Art. 106 Abs. 2 and Art. 108 BGG; requirements for reasoning of a complaint and summary non-entry: a submission must specifically address the decisive reasoning of the challenged decision and identify, with sufficient clarity, the alleged violation of federal law. Mere general criticism or unrelated allegations do not meet the pleading standard. If these requirements are not satisfied, the Federal Supreme Court does not enter into the matter in summary procedure. Costs are governed by Art. 66 Abs. 1 BGG and may be charged to the unsuccessful appellant.

Urteil vom 27. September 2008
Strafrechtliche Abteilung

Besetzung
Bundesrichter Schneider, Präsident,
Gerichtsschreiber Monn.

Parteien
X.________,
Beschwerdeführer,

gegen

Justiz- und Sicherheitsdepartement des Kantons Luzern, Bahnhofstrasse 15, 6002 Luzern,
Beschwerdegegner.

Gegenstand
Strafvollzug,

Lausanne, 27. September 2008

Im Namen der Strafrechtlichen Abteilung
des Schweizerischen Bundesgerichts
