Omnilex summary

The complainant challenged the refusal to open criminal proceedings against an investigating judge. The Federal Supreme Court held that the filing did not contain a sufficiently substantiated explanation of any criminal conduct and did not show any basis for the accusation against the cantonal court president. It therefore did not enter into the complaint under Art. 108 BGG. The request for legal aid was rejected because the complaint was hopeless, and costs of CHF 500 were imposed on the complainant.

Omnilex headnote

Art. 108 BGG; requirements of reasoning for a complaint to the Federal Supreme Court in summary non-entry proceedings; mere unsubstantiated allegations do not suffice. A complaint is inadmissible where it does not concretely engage with the contested decision and fails to show, in a legally relevant manner, why the authority’s assessment could be unlawful. Unsupported insinuations of criminal conduct or bias are insufficient. Where the main filing lacks prospects of success, legal aid is to be refused under Art. 64 BGG; costs may be reduced in consideration of the party’s financial circumstances under Art. 65(2) BGG and are imposed on the unsuccessful party under Art. 66(1) BGG.

Urteil vom 29. November 2010
Strafrechtliche Abteilung

Besetzung
Bundesrichter Favre, Präsident,
Gerichtsschreiber C. Monn.

Verfahrensbeteiligte
X.________,
Beschwerdeführer,

gegen

  1. Staatsanwaltschaft des Kantons St. Gallen, Schützengasse 1, 9001 St. Gallen,
  2. A.________,
    Beschwerdegegnerinnen.

Gegenstand

Extracted by Omnilex

Key legal question

Whether the complaint met the reasoning requirements for federal review of the refusal to open criminal proceedings.

Extracted holding

The complaint did not show, in a sufficiently reasoned manner, why the investigating judge could have acted criminally; the court therefore would not enter into the matter.

Extracted reasoning

The appellant merely made unsupported assertions about handling of reports, disclosure of personal data, requests for medical information, and humiliation/insult. He also failed to substantiate the allegation of collusion against the presiding member of the lower court. This did not satisfy Art. 108 BGG.

Key legal question

Whether legal aid should be granted on the federal complaint.

Extracted holding

Legal aid was refused because the requested relief had no prospects of success.

Extracted reasoning

Under Art. 64 BGG, assistance is unavailable where the claims are hopeless.

Key legal question

How the court costs should be allocated.

Extracted holding

Court costs of CHF 500 were imposed on the complainant, taking his financial situation into account.

Extracted reasoning

Costs follow the unsuccessful filing under Art. 66(1) BGG; the amount was reduced in light of his financial circumstances under Art. 65(2) BGG.
