Omnilex summary

The Federal Supreme Court held that the appellant, as a mere injured person and not a private prosecutor or victim with standing, could not challenge the merits of the cantonal refusal to proceed on a criminal complaint for false accusation and false testimony. His complaint about the assessment of suspicion was therefore an inadmissible merits attack rather than a permissible procedural complaint. The Court did not enter into the appeal, denied free legal aid because the appeal was hopeless, and imposed reduced court costs of CHF 500 on the appellant.

Omnilex headnote

Art. 81 Abs. 1 lit. b Ziff. 4 und 5 BGG; standing of the injured party to challenge a non-prosecution decision: a person who is neither private prosecutor nor victim may invoke only violations of procedural rights amounting to a denial of justice. Rulings attacking the existence of sufficient suspicion or the assessment of the merits are substantive in nature and are not reviewable absent standing (consid. 1). Art. 108 BGG permits non-entry where the complaint is manifestly inadmissible. Art. 64 BGG: legal aid is refused if the appeal appears hopeless. Art. 66 Abs. 1 and Art. 65 Abs. 2 BGG govern costs and allow a reduced fee in light of the party’s financial circumstances.

Urteil vom 29. November 2008
Strafrechtliche Abteilung

Besetzung
Bundesrichter Schneider, Präsident,
Gerichtsschreiber Monn.

Parteien
X.________,
Beschwerdeführer, vertreten durch Rechtsanwalt Dr. Gregor Benisowitsch,

gegen

Oberstaatsanwaltschaft des Kantons Zürich, Florhofgasse 2, 8001 Zürich, Beschwerdegegnerin.

Gegenstand
Nichteintreten auf Strafanzeige (falsche Zeugenaussage, falsche Anschuldigung etc.),

Beschwerde gegen den Beschluss des Obergerichts des Kantons Zürich, III. Strafkammer, vom 15. Oktober 2008.

Der Präsident zieht in Erwägung:

1.

4.
Dieses Urteil wird den Parteien und dem Obergericht des Kantons Zürich, III. Strafkammer, schriftlich mitgeteilt.

Extracted by Omnilex

Key legal question

Whether the complainant was entitled to appeal the cantonal non-prosecution decision on the merits

Extracted holding

He lacked standing as a mere injured person and could only raise procedural complaints amounting to a denial of justice.

Extracted reasoning

Because he was neither a private prosecutor nor an 'injured person' with standing under the Federal Supreme Court Act, substantive review of probable cause was unavailable; his attack on the assessment of suspicion was a merits complaint.

Key legal question

Whether the request for free legal aid should be granted

Extracted holding

It was refused because the appeal had no prospects of success.

Extracted reasoning

Under the Federal Supreme Court Act, legal aid is unavailable for clearly hopeless claims.

Key legal question

Allocation of court costs

Extracted holding

Court costs were imposed on the appellant, reduced in view of his financial situation.

Extracted reasoning

Costs follow the outcome, but the fee was reduced because of the appellant's limited means.
