Omnilex summary

The applicant sought revision of Federal Court judgment 6B_823/2013. The court had previously ordered a CHF 2,000 cost advance and set a deadline plus grace period, warning of non-entry if unpaid. As the advance was not paid, the Federal Court refused to enter into the revision request. The request for suspensive effect therefore became moot. Court costs of CHF 1,000 were charged to the applicant, with the amount increased in view of his dilatory conduct.

Omnilex headnote

Art. 62 and 66 BGG; revision proceedings and cost advance: where the applicant fails to pay the ordered advance within the set deadline and supplementary grace period after due warning, the Federal Court will not enter into the application. A pending request for suspensive effect becomes moot once non-entry is pronounced. In fixing court costs, the court may take into account dilatory or obstructive conduct under Art. 65(2) BGG; costs are otherwise borne by the unsuccessful party under Art. 66(1) BGG.

Obergericht des Kantons Zürich, III. Strafkammer, Postfach 2401, 8021 Zürich.

Gegenstand
Gesuch um Revision des Urteils des Schweizerischen Bundesgerichts 6B_823/2013 vom 9. Oktober 2013.

Das Bundesgericht zieht in Erwägung:

1.

3.

Dieses Urteil wird den Parteien und dem Obergericht des Kantons Zürich, III. Strafkammer, schriftlich mitgeteilt.

Extracted by Omnilex

Key legal question

Whether the revision application should be entered into despite non-payment of the required cost advance.

Extracted holding

No. Because the applicant failed to pay the ordered cost advance within the set deadline and grace period, the court did not enter into the revision application.

Extracted reasoning

The court had warned that failure to pay the CHF 2,000 advance by 4 December 2013 would lead to non-entry. Since payment was not made, the application had to be dismissed procedurally as inadmissible.

Key legal question

Whether the request for suspensive effect remained live after the non-entry decision.

Extracted holding

No. Once the court decided not to enter into the revision request, the suspensive-effect request became moot.

Extracted reasoning

The merits were not examined because the case was not entered into.

Key legal question

Allocation of court costs.

Extracted holding

Court costs were imposed on the applicant, with the amount set at CHF 1,000 taking into account his dilatory conduct.

Extracted reasoning

Under Arts. 66(1) and 65(2) BGG, costs fall on the unsuccessful party and the amount may reflect obstructive or dilatory litigation behavior.
