Non-entry for inadequate substantiation in enforcement appeal

7B.23/2006Federal Supreme Court / Criminal Division IIMar 7, 2006Dismissed

Omnilex summary

X. challenged the cantonal supervisory authority’s refusal to consider her complaint against the seizure of Y.'s co-ownership share, but she conceded that her cantonal filing had been late and explained only that she could not afford a lawyer. The Federal Supreme Court held that she failed to specify any federal-law violation by the cantonal non-entry decision, so the federal complaint was inadmissible. It also noted that she could have sought legal aid in the cantonal proceedings and that complaint proceedings under debt-enforcement law are generally free of charge.

Omnilex headnote

Art. 79 Abs. 1 OG; admissibility of a complaint to the Federal Supreme Court requires specific reasoning showing how the challenged decision violates federal law. A mere confirmation of the lateness of the cantonal filing, coupled with an explanation of lack of means, does not meet the substantiation requirement. The court will not examine the matter ex officio. In enforcement complaint proceedings, the possibility of applying for legal aid before the cantonal authority remains reserved; the procedure is in principle free of charge (Art. 20a SchKG; Art. 61 Abs. 2 lit. a GebV SchKG).

Urteil vom 7. März 2006
Schuldbetreibungs- und Konkurskammer

Besetzung
Bundesrichterin Hohl, Präsidentin,
Bundesrichter Meyer, Marazzi,
Gerichtsschreiber Schett.

Parteien
X.________,
Beschwerdeführerin,

gegen

Aufsichtsbehörde für Schuldbetreibung und Konkurs des Kantons Solothurn, Amthaus 1, 4502 Solothurn.

Gegenstand

Extracted by Omnilex

Key legal question

Whether the federal complaint was sufficiently reasoned to be admissible.

Extracted holding

No. The appellant did not even minimally explain how the cantonal non-entry decision violated federal law.

Extracted reasoning

A complaint must set out specific federal-law violations; a mere admission of lateness and inability to afford a lawyer does not satisfy the substantiation requirement.

Key legal question

Whether the appellant could rely on lack of funds to excuse the late filing before the cantonal authority.

Extracted holding

No determination in the operative part; the court only noted that legal aid could have been requested before the cantonal authority and that the complaint proceedings are generally free of charge.

Extracted reasoning

The court indicated that the appellant should have sought free legal aid in the cantonal proceedings and that the enforcement complaint procedure is ordinarily cost-free.
