Die Kammer hat nach Einsicht

in die Eingabe von X.________ vom 22. März 2006, womit dieser die Aufhebung der Verfügung des Zivilgerichtspräsidenten Basel-Stadt vom 7. März 2006 (P 2004 128) verlangt, mit welcher von ihm die Leistung eines Kostenvorschusses von Fr. 1'200.-- für die Ausarbeitung der schriftlichen Urteilsbegründung innert einer nicht erstreckbaren Nachfrist bis 31. März 2006 verfügt wurde, ansonsten die Appellation dahinfalle,

in das Gesuch des Beschwerdeführers um aufschiebende Wirkung sowie um Gewährung der unentgeltlichen Rechtspflege,

in Erwägung,
dass der Beschwerdeführer am 23. Mai 2005 Appellation erhoben hat gegen das Urteil des Zivilgerichts Basel-Stadt vom 13. Mai 2005, womit die Klage gemäss Art. 85a SchKG von Z.________ gutgeheissen und festgestellt wurde, dass die vom Beschwerdeführer in Betreibung gesetzte Forderung nicht bestehe,

dass die damit zusammenhängende Verfügung des Zivilgerichtspräsidenten Basel-Stadt vom 7. März 2006 zur Zahlung eines Kostenvorschusses nicht im Beschwerdeverfahren nach Art. 17 ff. SchKG beurteilt werden kann, weil keine Verfügung eines Betreibungs-, eines Konkursamtes oder einer Aufsichtsbehörde in SchKG-Sachen vorliegt,

dass aufgrund des Verfahrensstandes - entgegen der Ansicht des Beschwerdeführers - die Betreibung nicht fortgesetzt werden kann,

dass somit auf die Beschwerde nicht eingetreten werden kann,

dass mit dem Entscheid in der Sache das Gesuch um aufschiebende Wirkung gegenstandslos wird,

dass das Beschwerdeverfahren kostenlos ist (Art. 20a Abs. 1 SchKG) und das Gesuch um unentgeltliche Rechtspflege damit gegenstandslos wird,

dass die Beschwerde jedoch an Mutwilligkeit grenzt und der Beschwerdeführer zur Kenntnis zu nehmen hat, dass bei mut- oder böswilliger Beschwerdeführung einer Partei oder ihrem Vertreter Bussen bis zu Fr. 1'500.-- sowie Gebühren und Auslagen auferlegt werden können (Art. 20a Abs. 1 SchKG zweiter Satz),

erkannt:

Auf die Beschwerde wird nicht eingetreten.

Dieses Urteil wird dem Beschwerdeführer und dem Zivilgericht Basel-Stadt, Kammer Abt. P, schriftlich mitgeteilt.
