Omnilex summary

B.________ appealed a cantonal unemployment-insurance judgment to the Federal Supreme Court. The Court held that the appeal did not comply with the statutory reasoning requirements because it failed to explain how the factual findings were incorrect or legally defective. As the appeal period had also expired, the Court refused to enter into the matter in simplified procedure. Court costs of CHF 200 were imposed on the appellant.

Omnilex headnote

Art. 42 Abs. 1 and 2 BGG; Art. 97 Abs. 1 BGG; Art. 108 Abs. 1 lit. b BGG; non-entry for insufficient reasoning and expiry of the appeal period. An appeal must contain, within the appeal time limit, a concise statement of the requests and the reasons showing in what respect the challenged decision violates the law. A mere promise to file reasons later does not satisfy the formal requirements. Where the submission does not specifically contest the relevant factual findings or legal reasoning, and the statutory appeal period has elapsed, the Federal Supreme Court decides in simplified procedure not to enter into the matter (consid. 1). Court costs are borne by the unsuccessful appellant pursuant to Art. 66 Abs. 1 and 3 BGG (consid. 2).

Urteil vom 22. März 2011
I. sozialrechtliche Abteilung

Besetzung
Bundesrichter Ursprung, Präsident,
Gerichtsschreiber Grünvogel.

Verfahrensbeteiligte
B.________,
Beschwerdeführer,

gegen

Arbeitslosenkasse SYNA,
Route du Petit-Moncor 1, 1752 Villars-sur-Glâne,
Beschwerdegegnerin.

Gegenstand
Arbeitslosenversicherung (Prozessvoraussetzung),

Beschwerde gegen den Entscheid
des Kantonsgerichts Freiburg
vom 13. Januar 2011.

in Erwägung,

Extracted by Omnilex

Key legal question

Whether the appeal satisfied the formal reasoning requirements of Art. 42 BGG.

Extracted holding

The filing did not meet the minimum reasoning requirements because it failed to show why the factual findings were allegedly incorrect or legally flawed.

Extracted reasoning

An appeal must state requests and reasons concisely; the submission contained no adequate challenge to the factual findings under Art. 97 Abs. 1 BGG.

Key legal question

Whether the Federal Supreme Court could enter into the appeal despite expiry of the appeal time limit.

Extracted holding

No entry could be made because the 30-day appeal period had already expired and could not be extended.

Extracted reasoning

Since the appeal was deficient and the time limit under Arts. 44-48 BGG had expired, simplified non-entry under Art. 108 Abs. 1 lit. b BGG was warranted.

Key legal question

Who bears the court costs.

Extracted holding

The appellant must bear the costs.

Extracted reasoning

Costs follow the non-entering party under Art. 66 BGG.
