Omnilex summary

B. appealed to the Federal Supreme Court against a cantonal unemployment insurance judgment. Despite a prior warning from the court, his submission and subsequent filing did not contain a proper request or sufficient reasoning explaining any violation of federal law or erroneous fact-finding. The court held that no valid appeal existed and, in simplified proceedings, did not enter into the matter. It also ordered the appellant to pay court costs of CHF 300.

Omnilex headnote

Art. 42 Abs. 1 und 2 BGG; Art. 97 Abs. 1 BGG; Art. 108 Abs. 1 lit. b BGG; requirements for admissibility of a federal appeal. An appeal must contain a clear prayer for relief and a reasoned, issue-specific challenge to the contested decision; the submissions must make it apparent in which respects and for what reasons the decision is alleged to violate federal law. Abstract or unspecific criticism is insufficient. If the defects are not cured within the appeal period, the remedy is invalid and summary non-entry under Art. 108 Abs. 1 lit. b BGG is warranted (consid. 1). Costs are borne by the losing party under Art. 66 Abs. 1 and 3 BGG.

Urteil vom 25. April 2008
I. sozialrechtliche Abteilung

Besetzung
Bundesrichter Ursprung, Präsident,
Gerichtsschreiber Batz.

Parteien
B.________, Beschwerdeführer,

gegen

Regionales Arbeitsvermittlungszentrum (RAV), Beschwerdegegner, vertreten durch das Amt für Arbeit des Kantons St. Gallen,
Unterstrasse 22, 9000 St. Gallen.

Gegenstand
Arbeitslosenversicherung,

Beschwerde gegen den Entscheid des Versicherungsgerichts des Kantons St. Gallen
vom 7. Februar 2008.

Nach Einsicht
in die Beschwerde vom 25. Februar 2008 (Poststempel) gegen den Entscheid des Versicherungsgerichts des Kantons St. Gallen vom 7. Februar 2008,

in Erwägung,

3.
Dieses Urteil wird den Parteien, dem Versicherungsgericht des Kantons St. Gallen, der Kantonale Arbeitslosenkasse St. Gallen und dem Staatssekretariat für Wirtschaft schriftlich mitgeteilt.

Extracted by Omnilex

Key legal question

Whether the appeal met the formal requirements of Art. 42 BGG and could be examined on the merits.

Extracted holding

The filing did not contain a legally sufficient request or adequate reasoning showing how the cantonal decision violated federal law.

Extracted reasoning

Under Art. 42 BGG, an appeal must state requests and reasons; the party must specifically indicate why the challenged decision is unlawful. The submissions remained unspecific, and even after the court's notice they did not remedy these defects. It was also not discernible why the facts were allegedly established incorrectly under Art. 97(1) BGG.

Key legal question

Whether the court should enter into the appeal in simplified proceedings.

Extracted holding

Because no valid appeal had been filed, the court declined to enter into the matter in simplified proceedings.

Extracted reasoning

The formal defects meant the appeal was manifestly inadmissible, so non-entry under Art. 108(1)(b) BGG was appropriate.

Key legal question

Who bears the court costs.

Extracted holding

The appellant was ordered to pay court costs of CHF 300.

Extracted reasoning

Costs were imposed on the losing party pursuant to Art. 66(1) and (3) BGG.
