Omnilex summary

K.________ appealed to the Federal Supreme Court against a Federal Administrative Court interim order requiring a CHF 300 advance on costs and allowing withdrawal or supplementation of the appeal. The Supreme Court held that the filing did not satisfy the minimum reasoning requirements because it addressed only the merits of the disability pension claim and did not explain any legal error in the challenged order. The court therefore refused to enter into the appeal in simplified proceedings and waived court costs.

Omnilex headnote

Art. 42 Abs. 1 and 2 BGG; Art. 108 Abs. 1 lit. b BGG; admissibility of an appeal depends on a reasoned challenge to the contested decision. The appeal must contain requests and, in concise form, demonstrate in what respect the challenged act violates federal law. Mere submissions on the substantive merits of the underlying claim do not satisfy this threshold if they fail to engage with the specific reasoning or operative part of the order attacked. Where the reasoning requirement is manifestly unmet, the court may decline to enter into the appeal in simplified proceedings (consid. 1).

Urteil vom 31. März 2008
I. sozialrechtliche Abteilung

Besetzung
Bundesrichter Ursprung, Präsident,
Gerichtsschreiber Grünvogel.

Parteien
K.________, Beschwerdeführer,
Zustelldomizil: Frau M.________

gegen

IV-Stelle für Versicherte im Ausland, avenue Edmond-Vaucher 18, 1203 Genf, Beschwerdegegnerin.

Gegenstand
Invalidenversicherung,

Beschwerde gegen den Entscheid des Bundesverwaltungsgerichts
vom 12. Februar 2008.

in Erwägung,

Extracted holding

No. The filing contained only arguments on the merits of the disability pension claim and did not show any legal error in the challenged order.

Extracted reasoning

An appeal must set out the requests and reasons briefly and specifically; merely discussing the substantive entitlement without addressing the contested procedural order is insufficient.

Key legal question

Whether court costs should be charged.

Extracted holding

No court costs were imposed.

Extracted reasoning

In view of the inadmissibility decision, the court waived costs under Art. 66 Abs. 1 Satz 2 BGG.
