Omnilex summary

The appellant challenged a Schwyz cantonal court decision in an unemployment insurance matter, but his submission to the Federal Supreme Court did not contain adequate reasoning under Art. 42 BGG. The Court held that such a substantive defect cannot be cured by setting a deadline under Art. 42(5) or (6) BGG. It therefore declined to enter on the appeal. Because no court costs were imposed, the request for free legal aid became moot. The order was issued in summary procedure under Art. 108(1)(b) BGG.

Omnilex headnote

Art. 42 BGG; admissibility of appeals and irreparable substantive defects in reasoning; a remedy must contain requests and, in concise form, reasons showing how the challenged decision violates law. A merely insufficient substantive reasoning is not a curable formal defect within the meaning of Art. 42(5) or (6) BGG, so the appeal is not admitted under Art. 108(1)(b) BGG. If no court costs are levied under Arts. 65 and 66(1) BGG, a request for free legal aid becomes moot.

April 2007
In Erwägung,
Extracted by Omnilex

Key legal question

Whether the appeal met the reasoning requirements of Art. 42 BGG.

Extracted holding

No. The filing did not sufficiently explain in a concise manner how the challenged decision violated the law.

Extracted reasoning

Art. 42(1) and (2) BGG require requests and reasons; the submission failed to satisfy these requirements, so the appeal could not be substantively examined.

Key legal question

Whether a time limit should be set to cure the defective appeal.

Extracted holding

No. A cure period is only allowed in the cases listed in Art. 42(5) or (6) BGG; mere substantive insufficiency is not one of them.

Extracted reasoning

The defect concerned the content of the legal reasoning, not a curable formal defect under Art. 42(5) or (6) BGG.

Key legal question

Whether court costs should be charged and whether free legal aid remained to be decided.

Extracted holding

No court costs were levied, and the request for free legal aid became moot.

Extracted reasoning

Because no court costs were imposed, there was no need to decide the request for free procedural assistance.
