Omnilex summary

The appellant filed a social-insurance appeal against a judgment of the Obwalden Administrative Court. After being ordered to pay an advance and granted an extension, she still did not pay. The Federal Supreme Court therefore did not enter into the appeal in summary proceedings. It left open whether the later stated withdrawal of the appeal was formally valid. No court costs were charged.

Omnilex headnote

Art. 62 Abs. 3 BGG; Art. 108 Abs. 1 lit. a BGG: Non-payment of the required advance costs within the original or extended time limit justifies non-entry in simplified procedure. The court need not examine the merits. If the procedural outcome so warrants, it may waive court costs under Art. 66 Abs. 1 sentence 2 BGG. A subsequently declared withdrawal can remain open where non-entry is already mandatory for failure to pay the advance.

No; because the advance was not paid even during the extended deadline, the appeal could not be heard.

Under Art. 62(3) BGG, failure to pay the court-cost advance within the set or extended time limit permits non-entry in the simplified procedure under Art. 108(1)(a) BGG.

Key legal question

Whether court costs should be charged despite the non-entry.

Extracted holding

No court costs were imposed.

Extracted reasoning

Given the procedural outcome, the Court waived the levying of costs pursuant to Art. 66(1) second sentence BGG.
