Omnilex summary

A health-insurance appeal against the Zurich Social Insurance Court was filed to the Federal Supreme Court. The Court held that the appeal did not satisfy the reasoning requirements of Art. 42 BGG, because it failed to show in a legally sufficient way why the lower court's findings on premiums for July to September 2012, default interest, and ancillary costs were incorrect. The Court therefore did not enter into the appeal under the simplified procedure of Art. 108 BGG. In the circumstances, no court costs were imposed.

Omnilex headnote

Art. 42 Abs. 1 und 2 BGG; Art. 97 Abs. 1 BGG; Art. 108 Abs. 1 lit. b und Abs. 2 BGG; non-entry for insufficient reasoning: an appeal must, in a concise manner, explain how the challenged decision violates law. Where the submissions do not address the lower court's factual findings and reasoning in relation to the contested subject matter, the Federal Supreme Court cannot examine the merits and shall not enter into the appeal in simplified procedure (consid. 1). Art. 66 Abs. 1 Satz 2 BGG allows waiver of court costs in exceptional circumstances (consid. 2).

Helsana Versicherungen AG,
Beschwerdegegnerin.

Gegenstand
Krankenversicherung,

Oktober 2013,

in Erwägung,

1.

Auf die Beschwerde wird nicht eingetreten.

2.

Key legal question

Whether the federal appeal met the minimum reasoning requirements under Art. 42 BGG and could be examined on the merits.

Extracted holding

The appeal did not sufficiently show how the lower court's factual findings and legal reasoning were गलत/incorrect, so the court could not enter into the matter.

Extracted reasoning

The submissions did not explain, with the required condensed reasoning, why the facts found by the lower court regarding the disputed premiums, interest, and costs were inaccurate or legally flawed, as required by Art. 42 and Art. 97 BGG.

Key legal question

Whether court costs should be levied despite non-entry.

Extracted holding

Court costs were exceptionally waived.

Extracted reasoning

Applying Art. 66(1) second sentence BGG, the court refrained from charging costs in the circumstances.
