Omnilex summary

The appellant challenged a cantonal social-insurance decision, but his filing to the Federal Supreme Court did not contain a sufficiently reasoned attack on that decision. The Court held that the appeal failed to satisfy the minimum requirements of Art. 42 BGG and therefore did not enter into it in simplified proceedings under Art. 108 BGG. It further waived court costs.

Omnilex headnote

Art. 42 Abs. 1 und 2 BGG; Art. 108 Abs. 1 lit. b BGG; insufficiency of reasoning in an appeal. An appeal must contain requests and, in concise form, reasons showing how the contested decision violates the law. A submission that does not engage with the challenged judgment in a substantive, case-specific manner fails to meet the statutory minimum requirements and is manifestly inadmissible. In such a case, the presiding judge may issue a non-entry decision in simplified proceedings under Art. 108 Abs. 1 lit. b BGG. Where the circumstances so warrant, court costs may be waived pursuant to Art. 66 Abs. 1 second sentence BGG.

Urteil vom 7. April 2008
II. sozialrechtliche Abteilung

Besetzung
Bundesrichter U. Meyer, Präsident,
Gerichtsschreiber R. Widmer.

Parteien
A.________, Beschwerdeführer,

gegen

IV-Stelle Bern, Chutzenstrasse 10, 3007 Bern,
Beschwerdegegnerin.

Gegenstand
Invalidenversicherung,

Beschwerde gegen den Entscheid des Verwaltungsgerichts des Kantons Bern
vom 21. Januar 2008.

in Erwägung,

Extracted by Omnilex

Key legal question

Whether the appeal met the minimum requirements of Art. 42 BGG

Extracted holding

No. The filing did not contain a sufficiently reasoned, case-specific challenge to the cantonal decision.

Extracted reasoning

An appeal must state requests and reasons, and explain in summary form how the contested decision violates the law. The submission failed to do so, so no reviewable allegation of legal error was shown.

Key legal question

Whether the appeal should be dealt with under the simplified procedure of Art. 108 BGG

Extracted holding

Yes. Because the appeal was manifestly insufficiently reasoned, the presiding judge could decide not to enter into it summarily.

Extracted reasoning

The lack of any substantive challenge made non-entry obvious.

Key legal question

Whether court costs should be charged

Extracted holding

No court costs were imposed.

Extracted reasoning

The court waived costs under Art. 66(1) second sentence BGG.
