Omnilex summary

The Federal Supreme Court did not enter into the IV office’s appeal against the cantonal decision restoring the suspensive effect of the insured person’s appeal. It held that such decisions are interim measures and can be challenged only for violation of constitutional rights. Because the appellant failed to substantiate any constitutional complaint, the appeal was dismissed in simplified procedure without exchange of submissions. Court costs of CHF 500 were charged to the IV office, and no party compensation was granted to the insured person.

Omnilex headnote

Art. 93, 98, 106 Abs. 2 and 108 Abs. 1 lit. b BGG; appeal against a decision granting or restoring suspensive effect. Decisions on suspensive effect constitute interim measures within the meaning of Art. 98 BGG. In such proceedings, only the violation of constitutional rights may be invoked; the Federal Supreme Court examines such violations only if they are expressly alleged and substantiated. If the appeal contains no sufficiently reasoned constitutional complaint, it is inadmissible in the simplified procedure without exchange of submissions (consid. 1). Costs are borne by the unsuccessful party; party compensation is excluded where no compensable expenses were incurred (consid. 2).

Besetzung
Bundesrichter U. Meyer, Präsident,

Gerichtsschreiber Attinger.

Parteien
IV-Stelle des Kantons St. Gallen, Brauerstrasse 54, 9016 St. Gallen, Beschwerdeführerin,

gegen

W.________, Beschwerdegegnerin, vertreten durch Rechtsanwalt Robert Baumann, Brühlgasse 39, 9000 St. Gallen.

Gegenstand
Invalidenversicherung,

in Erwägung,

3.
Dieses Urteil wird den Parteien, dem Versicherungsgericht des Kantons St. Gallen, der Ausgleichskasse des Kantons St. Gallen und dem Bundesamt für Sozialversicherungen zugestellt.

Key legal question

Whether the appeal against the decision on suspensive effect was admissible under the Federal Supreme Court Act.

Extracted holding

The appeal was inadmissible because the challenged decision was an interim measure; only constitutional rights could be invoked, but none were sufficiently raised.

Extracted reasoning

Decisions on suspensive effect are interim decisions and, as measures of interim relief, may be challenged only for violation of constitutional rights. The appellant did not substantiate any such violation, so the simplified non-entry procedure applied.

Key legal question

Allocation of court costs and party compensation.

Extracted holding

Court costs were imposed on the losing appellant, and no party compensation was awarded to the respondent because no compensable expenses were incurred.

Extracted reasoning

Costs follow the outcome; the respondent incurred no reimbursable expenses in the federal proceedings.
