Omnilex summary

The Federal Supreme Court did not enter into the complaint against the Zurich Social Insurance Court’s interlocutory decision in an old-age and survivors' insurance matter. It held that the filing did not contain a proper request or sufficient reasoning as required by Art. 42 BGG, and it did not adequately address appealability under Art. 93 para. 1 BGG. The case was therefore resolved in simplified procedure under Art. 108 para. 1 lit. b BGG. No court costs were levied.

Omnilex headnote

Art. 42 Abs. 1 und 2 BGG; Art. 93 Abs. 1 BGG; Art. 108 Abs. 1 lit. b BGG; inadmissibility of an appeal for lack of proper prayer and substantiation. A federal appeal must contain a clear request and a concise statement explaining in what respect the challenged act violates law; mere criticism is insufficient. Where the appeal challenges an interlocutory decision, the appellant must specifically address the prerequisites of appealability under Art. 93 BGG. If these minimum requirements are not met, the Court may refuse to enter into the matter in simplified procedure. Costs may be waived under Art. 66 Abs. 1 second sentence BGG.

Gegenstand

Februar 2010,

in Erwägung,

Extracted by Omnilex

Key legal question

Whether the appeal satisfied the minimum reasoning and prayer requirements under the Federal Supreme Court Act.

Extracted holding

No; the filing contained no proper request and did not show, in a legally sufficient way, why the challenged decision violated federal law or why the factual findings were wrong.

Extracted reasoning

The appeal failed to meet Art. 42 paras. 1 and 2 BGG because it lacked an admissible prayer and any coherent explanation of legal error or incorrect fact-finding.

Key legal question

Whether the interlocutory decision could be challenged under Art. 93 para. 1 BGG.

Extracted holding

This was not addressed in a legally sufficient manner by the appellant, so the Court could not treat the complaint as properly substantiated on this point.

Extracted reasoning

The submission did not engage with the question whether the lower court's interlocutory decision met the conditions for appealability under Art. 93 para. 1 BGG.

Key legal question

Whether court costs should be charged.

Extracted holding

No court costs were levied.

Extracted reasoning

Given the summary non-entry procedure, the Court waived costs under Art. 66 para. 1 second sentence BGG.
