Omnilex summary

The Federal Supreme Court dealt with an appeal in an AHV matter against a cantonal administrative judgment. It held that the appeal was filed after the 30-day time limit and, independently, that the submission did not contain a sufficient statement of reasons. Because there was no valid appeal, legal aid was refused. The court exceptionally waived court costs and notified the parties, the cantonal court, and the Federal Social Insurance Office.

Omnilex headnote

Art. 100 Abs. 1, Art. 42 Abs. 1 and 2, Art. 64 and Art. 66 Abs. 1 BGG; inadmissibility of an appeal filed out of time and lacking adequate reasoning. An appeal must be lodged within the statutory period and contain a concise, substantiated statement of the grounds of challenge. Failure to comply with either requirement leads to non-entry in simplified proceedings under Art. 108 Abs. 1 lit. a and b BGG. In the absence of a valid appeal, legal aid is excluded. The court may exceptionally waive the collection of costs under Art. 66 Abs. 1 sentence 2 BGG.

Beschwerdegegnerin.

Gegenstand

in Erwägung,
