Omnilex summary

The appellant challenged a cantonal insurance court's non-entry decision before the Federal Supreme Court. The appeal brief did not satisfy the statutory reasoning requirements because it did not explain in a legally cognizable way why the cantonal decision was wrong. In simplified procedure, the President declared the appeal inadmissible without granting a remedy period. The court also waived court costs in view of the circumstances.

Omnilex headnote

Art. 42 Abs. 1 and 2 BGG; Art. 108 Abs. 1 lit. b BGG; inadmissibility for insufficient reasoning. A federal appeal must contain, in concise form, prayers for relief and reasons showing how the challenged decision violates law. Mere dissatisfaction with the lower-court ruling is insufficient. If the submission manifestly fails to meet these minimum requirements, the court may decline to enter without setting a time limit to cure the defect. Under Art. 66 Abs. 1 second sentence BGG, costs may exceptionally be waived in view of the circumstances.
