Omnilex summary

The claimant appealed a Federal Administrative Court non-entry ruling in an invalidity insurance case. The Federal Supreme Court held that the appeal did not satisfy the minimum reasoning requirements because it contained no request and no substantive engagement with the challenged non-entry decision. The filing merely referred to a claim and enclosed medical records. The Court therefore did not enter into the appeal in simplified procedure. It further waived court costs, rendering the request for legal aid concerning cost exemption moot.

Omnilex headnote

Art. 42 Abs. 1 and 2 BGG; Art. 108 Abs. 1 lit. b BGG; insufficient reasoning of a federal remedy against a non-entry decision. A remedy must contain requests and, in concise form, reasons showing how the challenged act violates law. Where an appeal against a non-entry ruling addresses only the merits and contains no substantive discussion of the non-entry itself, it does not satisfy the requirements of Art. 42 BGG and is manifestly inadmissible. In such a case, the court may decline to enter into the matter in simplified procedure under Art. 108(1)(b) BGG (consid. 1). If no court costs are levied, a request for exemption from costs becomes moot (consid. 2).

Urteil vom 3. Dezember 2007
II. sozialrechtliche Abteilung

Besetzung
Bundesrichter U. Meyer, Präsident,
Gerichtsschreiber Attinger.

Parteien
S.________, 1955, Beschwerdeführer,

gegen

IV-Stelle für Versicherte im Ausland,
Avenue Edmond-Vaucher 18, 1203 Genf,
Beschwerdegegnerin.

Gegenstand
Invalidenversicherung,

Beschwerde gegen den Entscheid des Bundesverwaltungsgerichts vom
3. September 2007.

Nach Einsicht
in die von S.________ erhobene Beschwerde vom 3. Oktober 2007 gegen den Nichteintretensentscheid des Bundesverwaltungsgerichts vom 3. September 2007,
in Erwägung,

Extracted by Omnilex

Key legal question

Whether the appeal met the statutory requirements of reasoning under Art. 42 BGG.

Extracted holding

No. The filing contained neither a request nor any substantive challenge to the lower court's non-entry decision.

Extracted reasoning

A remedy must state requests and reasons; in a non-entry appeal, merely addressing the merits is insufficient. Here the submission only mentioned entitlement and medical records.

Key legal question

Whether the Federal Supreme Court should enter into the appeal under the simplified procedure of Art. 108(1)(b) BGG.

Extracted holding

No. The appeal was manifestly inadmissible for lack of sufficient reasoning, so non-entry was appropriate.

Extracted reasoning

Because the appeal lacked any legally sufficient reasoning, the president could decide in simplified procedure not to enter into the matter.

Key legal question

Whether court costs should be charged and whether legal aid for exemption from costs remained relevant.

Extracted holding

No court costs were imposed; the request for legal aid exemption became moot.

Extracted reasoning

In view of the non-entry decision, the court dispensed with court costs under Art. 66(1) second sentence BGG.
