Omnilex summary

The appellant challenged a decision of the Zurich Social Insurance Court in an occupational pension matter. The Federal Court held that the appeal did not meet the mandatory reasoning requirements of Art. 42 BGG, because it did not sufficiently show how the cantonal court allegedly violated federal law or made erroneous factual findings. In simplified procedure, the President therefore declined to enter into the appeal. Court costs of CHF 300 were charged to the appellant.

Omnilex headnote

Art. 42 Abs. 1 und 2 BGG; Art. 108 Abs. 1 lit. b BGG; Art. 66 Abs. 1 und 3 BGG; an appeal must contain requests and a reasoned submission showing, in concise form, how the challenged decision infringes federal law. Mere criticism, incomprehensible argumentation, or unspecific objections to factual findings is insufficient. If the minimum reasoning requirements are manifestly not met, the President may refuse to enter into the appeal in simplified procedure; costs are borne by the losing party.

Berufliche Vorsorge,

Juni 2010,

in Erwägung,

Extracted by Omnilex

Key legal question

Whether the appeal met the formal reasoning requirements of Art. 42 BGG.

Extracted holding

No. The appeal did not set out in a concise manner how the challenged decision violated federal law.

Extracted reasoning

The submission did not explain, even implicitly in a legally usable way, why the factual findings were allegedly incorrect or why the cantonal court's reasoning would violate Art. 95 or Art. 97 BGG.

Key legal question

Whether the appeal should be entered into under the simplified procedure of Art. 108(1)(b) BGG.

Extracted holding

No entry was warranted because the appeal manifestly failed to satisfy the minimum content requirements.

Extracted reasoning

Where the appeal is obviously insufficiently reasoned, the president may refuse to enter into it in simplified procedure.

Key legal question

Allocation of court costs.

Extracted holding

The appellant was ordered to pay court costs of CHF 300.

Extracted reasoning

Under Art. 66 BGG, the losing party bears the costs; no basis for a deviation was stated.
