Omnilex summary

The appellant sought federal review of a Zurich social insurance court non-entry decision in an AVS matter. The Federal Supreme Court held that the appeal did not satisfy the minimum reasoning requirements: it contained no proper request and did not show how the factual findings were wrong or the legal reasoning unlawful. Because the appeal manifestly failed to meet Art. 42 BGG, the Court did not enter into the matter in simplified procedure under Art. 108 Abs. 1 lit. b BGG. Court costs were waived.

Omnilex headnote

Art. 42 Abs. 1 and 2 BGG; Art. 97 Abs. 1 BGG; Art. 108 Abs. 1 lit. b BGG; non-entry for manifestly insufficient reasoning. An appeal must contain specific conclusions and, in concise form, reasons showing how the challenged decision violates law. Mere objection to the outcome or factual findings without precise criticism does not satisfy the statutory minimum requirements. Where the submission is manifestly deficient, the Federal Supreme Court may refuse to enter into the matter in simplified procedure. Costs may be waived under Art. 66 Abs. 1 sentence 2 BGG.

II. sozialrechtliche Abteilung

Besetzung
Bundesrichter U. Meyer, Präsident,
Gerichtsschreiber R. Widmer.

Verfahrensbeteiligte
L.________,
Beschwerdeführerin,

gegen

Ausgleichskasse des Kantons Zürich, Röntgenstrasse 17, 8005 Zürich,
Beschwerdegegnerin.

Gegenstand
Alters- und Hinterlassenenversicherung,

Beschwerde gegen den Beschluss
des Sozialversicherungsgerichts des Kantons Zürich
vom 9. Oktober 2012.

Oktober 2012,

in Erwägung,

1.
Auf die Beschwerde wird nicht eingetreten.

2.
Es werden keine Gerichtskosten erhoben.

Key legal question

Whether the federal appeal met the formal requirements of Art. 42 BGG and Art. 97 BGG.

Extracted holding

No. The appeal did not contain a legally sufficient request and did not explain any violation of law or erroneous factual findings.

Extracted reasoning

The submissions failed to state concretely how the challenged decision violated federal law; no proper challenge to the lower court's refusal to enter into the earlier complaint was raised.

Key legal question

Whether the Federal Supreme Court could enter into the appeal under the simplified procedure.

Extracted holding

No. Because the appeal was manifestly insufficiently reasoned, it was dismissed from the docket in simplified procedure.

Extracted reasoning

Manifest non-compliance with the minimum requirements of Art. 42 BGG justified non-entry under Art. 108 Abs. 1 lit. b BGG.

Key legal question

Court costs

Extracted holding

No court costs were levied.

Extracted reasoning

The Court waived costs under Art. 66 Abs. 1 sentence 2 BGG.
