Non-payment of advance costs leads to non-entry

C 321/05Federal Supreme Court / Social Insurance Division IFeb 2, 2006Dismissed

Omnilex summary

S.________ appealed a Solothurn insurance-court decision to the Federal Insurance Court. Because the proceeding was not about insurance benefits, it was subject to costs. The court ordered an advance payment of CHF 700 and warned that failure to pay would lead to non-entry. The advance was not paid within the deadline, even accounting for the statutory suspension of time limits. The court therefore did not enter into the appeal and, in line with its practice, imposed no court costs.

Omnilex headnote

Art. 134 OG e contrario, Art. 150 Abs. 4 OG, Art. 34 Abs. 1 OG; if a cost-bearing appeal is filed, the court may require an advance of costs and warn of non-entry upon non-payment. Where the advance is not paid within the statutory deadline, taking into account any suspension of time limits, the court must not enter into the appeal. In such non-entry decisions for failure to pay the advance, no court costs are ordinarily charged as a matter of practice.

In Erwägung,

Key legal question

Whether the administrative appeal could proceed despite non-payment of the ordered advance costs.

Extracted holding

The court could not entertain the appeal because the advance costs were not paid in time after due warning.

Extracted reasoning

The case was cost-bearing; the appellant was ordered to pay an advance of CHF 700 with a non-entry warning. The amount was not paid within the deadline, taking account of the statutory suspension of time limits, so non-entry under Art. 150(4) OG followed.

Key legal question

Whether court costs should be charged for the non-entry decision.

Extracted holding

No court costs were imposed.

Extracted reasoning

Although the proceeding was generally subject to costs, the court applied its practice not to charge costs when it issues a non-entry decision due to missing or late payment of the advance.
