Omnilex summary

A tenant suffering from allergies to mites and grasses sought authorization to move from a studio to a larger and more expensive apartment so that she could install a proper bed and other furnishings needed for her condition. The court held that Art. 39a LGL, which does not force a tenant to accept a cheaper exchange when it creates a major inconvenience, likewise does not require the tenant to remain in the former flat when staying would cause the same problem. The inability to use necessary furniture for allergy management constituted a major inconvenience, so the move was justified.

Omnilex headnote

Art. 39a LGL; major inconvenience justifying a move to a larger and more expensive dwelling. The statutory limitation on requiring a tenant to accept a cheaper exchange is symmetrical: it also precludes compelling the tenant to remain in the former dwelling when this would entail a major inconvenience. A serious impairment of living conditions, such as the inability to install essential furniture needed to alleviate allergy-related ailments, qualifies as a major inconvenience within the meaning of the provision and may justify allocation of a larger flat.

Key legal question

Whether a tenant may be required under Art. 39a LGL to remain in a cheaper flat despite a major inconvenience caused by her health condition.

Extracted holding

No. The same rule that does not compel a tenant to accept a cheaper exchange when it causes major inconvenience also does not require the tenant to stay in the former flat when remaining there would cause such inconvenience.

Extracted reasoning

The inability to install furniture necessary to mitigate allergic conditions, in particular a proper bed, amounted to a serious inconvenience. That justified moving to a larger flat even though it was more expensive.
