Gemäss § 36 Abs. 5 StG wird die nachträgliche Vermögenssteuer in einem besonderen, von der ordentlichen Einschätzung unabhängigen Verfahren festgesetzt. Die Vollzugsverordnung zum Steuergesetz bestimmt in § 53 Abs. 1 als Veranlagungsbehörde für die nachträgliche Vermögenssteuer den für die Erhebung der Grundstückgewinnsteuer zuständigen Gemeinderat, der diese Aufgabe der Gemeindekanzlei oder dem Steueramt übertragen kann.

Im vorliegenden Fall hat das Steueramt X die nachträgliche Vermögenssteuer veranlagt und die dagegen eingereichte Einsprache entschieden. Ein förmlicher Delegationsbeschluss des Gemeinderates, mit welchem er die vom Gesetz primär ihm überbundene Aufgabe auf das Steueramt übertragen hätte, liegt unbestrittenermassen nicht vor. Hingegen bestätigt der Gemeinderat, dass das Steueramt seit jeher sämtliche Verrichtungen im Zusammenhang mit der Veranlagung nachträglicher Vermögenssteuern vorgenommen hat. Damit steht fest, dass der Gemeinderat mindestens durch konkludentes Verhalten von seiner Übertragungskompetenz Gebrauch gemacht hat. Die Veranlagungsbefugnis des Steueramtes X sowie dessen Zuständigkeit auch als Einspracheinstanz sind somit gegeben. Denn nach § 53 Abs. 3 StV sind auf das Einspracheverfahren die Vorschriften des GGStG entsprechend anzuwenden. § 28 GGStG bestimmt als Einspracheinstanz den Gemeinderat. Daher hat bei der nachträgliehen Vermögenssteuer also grundsätzlich der Gemeinderat und nicht wie im ordentlichen Veranlagungsverfahren die Staatssteuerkommission die Einsprache zu behandeln. Hat der Gemeinderat aber seine Veranlagungskompetenz an das Steueramt delegiert, so ist dieses auch für die Einsprache zuständig; denn die Einsprache verpflichtet die erstinstanzliche Verwaltungsbehörde, ihren angefochtenen Entscheid zu überprüfen und nochmals über die Sache zu entscheiden (§ 117 VRG).
