Standing to appeal legal aid decision requires realistic security-for-costs interest

JK 97 193+197/160Other CourtJul 16, 1997Inadmissible

Omnilex summary

The defendant challenged the plaintiff's granted legal aid on the ground that the plaintiff allegedly had sufficient financial means. The court held that the opposing party may appeal such a decision only if a request for security for costs would realistically be available and must demonstrate that interest. Because the defendant did not establish any security-for-costs ground, it lacked a legally protected interest. The appeal was therefore not entered into.

Omnilex headnote

§ 125 Abs. 1 ZPO, § 134 Abs. 3 ZPO; § 100 Abs. 1 lit. d i.V.m.

§ 104 Abs. 3 ZPO).

Key legal question

Whether the defendant is entitled to appeal the grant of legal aid to the plaintiff.

Extracted holding

The defendant has standing only if a request for security for costs would seriously come into question for him, and he must substantiate that condition.

Extracted reasoning

The defendant relied only on the plaintiff's alleged ability to finance the proceedings. That does not establish a security-for-costs ground under § 125(1) ZPO. If the opposing party does not realistically come into question for security, it has no legally protected interest in challenging the grant of legal aid.
