Die Beklagte will ihr - zwar als Rekurs/Beschwerde bezeichnetes - Rechtsmittel als Rekurs behandelt wissen. Sie beruft sich bezüglich der Zulässigkeit des Rekurses auf § 254 Abs. 2 ZPO. Nach dieser Bestimmung ist der Rekurs statthaft gegen ein Erkenntnis, wodurch ein appellabler Zivilprozess sistiert wird, bis ein anderer Zivil oder Strafprozess erledigt ist. Was die Beklagte jedoch übersieht, ist die Tatsache, dass der Gesetzgeber gegen die Sistierung ablehnende Entscheide - und um einen solchen geht es vorliegend - das Rechtsmittel des Rekurses gerade nicht gegeben hat. Und dies mit gutem Grund: Die Gutheissung eines Sistierungsbegehrens kann wegen der dadurch bewirkten Ruhe des Verfahrens für die Gegenpartei mit nachhaltigen Folgen verbunden sein, unter Umständen mit nicht wiedergutzumachenden Nachteilen. Nachdem das Gesetz für den vorliegenden Fall den Rekurs nicht vorsieht (§ 254 Abs. 1 ZPO), ist das von der Beklagten eingelegte Rechtsmittel als Beschwerde entgegenzunehmen und der vorinstanzliche Entscheid lediglich unter dem Gesichtspunkt der offenbaren Gesetzesverletzung zu prüfen (§ 282 Abs. 1 lit. a ZPO).
