Omnilex summary

The court held that legal services provided by the notary were ancillary to the notarization transactions because they were directly connected with them. If compensation claims arising from notarization work and related ancillary services are disputed, they must be decided finally by the same cantonal instance. Accordingly, the supervisory authority over the notaries has jurisdiction over the entire claim under § 53 BeurkG.

Omnilex headnote

§ 53 BeurkG; jurisdiction over compensation claims arising from notarization work and ancillary services: services performed by a notary that are in direct connection with notarization transactions are ancillary services to public notarization. If compensation claims for notarization activity and such ancillary services are disputed, final adjudication must be rendered by the same cantonal instance; the supervisory authority over notaries is competent for the whole claim.

Key legal question

Whether ancillary legal services closely connected to notarization count as part of the notarization activity for jurisdictional purposes.

Extracted holding

Yes. The lawyer-like services performed by the notary were directly connected to the notarization acts and therefore constituted ancillary services to public notarization.

Extracted reasoning

Services that are immediately related to notarization are not to be treated separately; they fall within the same compensation dispute framework as the notarization work itself.

Key legal question

Which cantonal body is competent to finally decide a disputed claim for compensation arising from notarization activity and related ancillary services.

Extracted holding

The supervisory authority over notaries is competent to decide the entire claim under § 53 BeurkG.

Extracted reasoning

Where compensation claims from notarization and related ancillary services are disputed, their final determination must be made by the same cantonal instance; therefore the supervisory authority has jurisdiction over the full claim.
