Omnilex summary

The decision states that, although cost advances may generally be required from plaintiffs, counterclaimants and private complainants under §§ 123 Abs. 1 ZPO and 271 StPO, this practice is to be abandoned immediately for Lucerne public bodies within the meaning of § 1 VRG, except for expert opinion costs. Such bodies are to be billed only after the proceedings. If they succeed, they may recover those costs from the opposing party under § 18 KoG.

Omnilex headnote

§§ 123 Abs. 1 ZPO, 271 StPO; § 1 VRG; § 18 KoG; cost advances for public bodies: Lucerne public bodies are to be exempted from advance payment of court costs, save for expert opinion costs. The court distinguishes between advance payment and ultimate cost liability: while advances may ordinarily be demanded, public bodies are to be invoiced only after conclusion of the proceedings, with reimbursement claims against the opposing party arising upon success. The rule is justified by practice continuity with summary enforcement proceedings and applies immediately (consid. not stated).
