Die als Schiedsgericht angerufene Aufsichtsbehörde über die Rechtsanwälte hatte in einem Mandatsprozess zu prüfen, wie es sich grundsätzlich mit der Beweislast betreffend Anwaltshonorar verhält.

Aus den Erwägungen:

Wer aus Vertrag klagt, hat dessen Zustandekommen zu beweisen. Er hat die Einigung der Vertragspartner über die wesentlichen Bestandteile des Vertrages darzutun (BGE 99 II 338; Kummer, Berner Komm., N 233 zu Art. 8 ZGB). Der Kläger hat somit als Beauftragter, der einen Honoraranspruch geltend macht, Bestand und Inhalt des Auftragsverhältnisses mit der Beklagten nachzuweisen. Dazu gehört grundsätzlich auch der Beweis der (richtigen) Erfüllung. Der Kläger muss beweisen, dass seine Leistung in Erfüllung einer bestimmten Verpflichtung erfolgte und dem Inhalt dieser Verpflichtung entsprach (Fellmann, Berner Komm., N 488 zu Art. 394 OR). Dabei ist zu beachten, dass der Rechtsanwalt im Auftragsverhältnis keinen Erfolg, sondern lediglich die vertragsgemässe Besorgung des übernommenen Geschäftes schuldet (Art. 394 Abs. 1 OR). Sofern und soweit er dieser Verpflichtung nachkommt, hat der Anwalt sein Honorar verdient. Den Mandanten trifft grundsätzlich das Risiko, den Anwalt auch dann bezahlen zu müssen, wenn der angestrebte Erfolg ausbleibt (Gmür Philipp, Die Vergütung des Beauftragten, Diss. Freiburg 1994, S.145). Will der Auftraggeber das Honorar nicht bezahlen, indem er nicht richtige oder schlechte Erfüllung des Auftrags geltend macht, bleibt es - wie erwähnt - grundsätzlich Sache des Beauftragten, die einwandfreie Besorgung des Auftrags nachzuweisen. Eine Umkehr der Beweislast besteht jedoch dort, wo der Auftraggeber die Leistungen des Beauftragten vorbehaltlos entgegennimmt oder durch sein Verhalten erkennen lässt, dass er mit der Ausführung durch den Beauftragten zufrieden ist. Lässt der Mandant die Prozessführung (über deren Stand er ordnungsgemäss auf dem laufenden gehalten wurde) durch den Anwalt widerspruchslos geschehen oder erklärt er sich sogar mit den jeweiligen Entwürfen der Rechtsschriften ausdrücklich einverstanden, kann er dem Beauftragten später nicht den Beweis dafür zuschieben, seine Sorgfaltspflichten erfüllt zu haben. Will er nicht zahlen, muss er selbst beweisen, dass der beauftragte Anwalt den Auftrag schlecht erfüllt hat (Fellmann, a.a.O., N 489-494 zu Art. 394 OR).
