Omnilex summary

The Regierungsrat held that a house demolished and rebuilt at another location is to be treated as a new building within the meaning of Art. 3 BauG and therefore requires a building permit. The decision emphasizes that if even less intrusive works such as alterations or repainting are permit-related, the substantially more significant change of location must a fortiori be examined and authorized, especially because setback rules, traffic safety, and landscape protection may be affected.

Omnilex headnote

Art. 3 BauG; relocation of a building by demolition and reconstruction at another site requires a permit. A house moved to a different location is not materially distinguishable from a new building within the meaning of the provision. The permit requirement is justified a fortiori where even lesser interventions, such as alterations or changes in color, are already subject to authorization. The decisive considerations are the possible impact on building setbacks, traffic safety, and landscape protection (consid. 1).

Entscheidpublikation VVGE 1971/75 Nr. 61, S. 65:

Art. 3 BauG.

Bewilligungspflicht der Verschiebung eines Hauses.

Entscheid des Regierungsrates vom 23. Dezember 1974 (Nr. 967).

Key legal question

Whether demolishing a house and reconstructing it at another location counts as a permit-required new building under Art. 3 BauG.

Extracted holding

Yes. Demolition and reconstruction at another site is treated as a new building and is therefore subject to a building permit; no relevant distinction exists from the relocation of a house.

Extracted reasoning

The relocation is a more significant intervention than minor works already subject to permit requirements, such as alterations or even changes in color. Because a change of location can affect building setbacks, traffic safety, and landscape protection, it must be reviewed and authorized.
