Omnilex summary

The decision holds that the Department of the Interior lacks directive authority over the councils of political municipalities in relation to a stationary facility for the elderly when the facility is operated by a Zweckverband with its own legal personality. The dispute turned on the scope of state supervision versus municipal self-government and the legal autonomy of the association structure.

Omnilex headnote

Art. 155 Abs. 2, Art. 158 lit. a and b GG; Art. 28 Abs. 2 lit. a and Art. 32 ff. SHG; supervisory authority over municipalities and association-operated institutions. The cantonal supervisory competence does not, as such, include a hierarchical power of instruction toward political municipality councils where the relevant institution is managed by a Zweckverband endowed with legal personality. The association’s autonomous organizational form precludes treating the municipal councils as addressees of departmental directives in the operation of the facility; supervision remains limited to the legally provided forms of oversight (consid. not specified).

Key legal question

Whether the Department of the Interior may give binding instructions to political municipality councils concerning a stationary elderly-care institution run by a legally independent Zweckverband.

Extracted holding

No. The Department is not entitled to issue directives to the municipal councils in that constellation.

Extracted reasoning

State supervisory powers under the cantonal communal law do not create directive authority where the institution is operated by a Zweckverband with its own legal personality; the supervisory relationship is therefore not one of hierarchical instruction toward the municipal councils.
