Omnilex summary

The court states that the first instance was properly conducted by the single judge of the Kreisgericht under Art. 295 ZPO and Art. 6 EG ZPO. It further holds that no conciliation hearing was required because the action is one concerning personal status within Art. 198 lit. b ZPO, and this also covers the maintenance claim linked to paternity. The appellate authority is the II. Civil Chamber of the Cantonal Court under Art. 16 EG ZPO. The decision is not yet final.

Aus den Erwägungen:

Juli 2011, CAN – Zeitschrift für kantonale Rechtsprechung 2012, 89, 92; OGer ZH, 6. Juli 2012, www.gerichte-zh.ch [Vaterschaftsklage]; Dike-Komm/Gasser/Rickli, Schweizerische Zivilprozessordnung, Art. 198 ZPO, N 3; Hofmann/Lüscher, Le Code de procédure civile, 108; Möhler, in: Gehri/Kramer, Schweizerische Zivilprozessordnung, Art. 198 ZPO, N 7; Scherrer, Diskussionspunkte anlässlich der Weiterbildung des Kantonsgerichtes St. Gallen vom 30. Im Berufungsverfahren entscheidet die II. Zivilkammer des Kantonsgerichts (Art. 16 EG ZPO).
