SOG 2001 Nr. 5 ** Art. 175 ZGB.** Ein Ehegatte, der selbst einen neuen Lebenspartner hat, ist nicht berechtigt, dem andern das Getrenntleben zu verweigern. * Sachverhalt (gekürzt):* Im Eheschutzprozess vor erster Instanz wurde der Ehemann verpflichtet, seiner Gattin und dem gemeinsamen Sohn monatliche Unterhaltsbeiträge zu leisten. Hiergegen erhob der Ehemann Rekurs: Es sei namentlich der Unterhaltsbeitrag der Ehefrau aufzuheben. Die Zivilkammer heisst den Rekurs teilweise gut. * Aus den Erwägungen:* 9. Der Ehemann macht geltend, weil die Ehefrau gemäss Art. 175 des Zivilgesetzbuches (ZGB, SR 210) gar nicht berechtigt sei, getrennt zu leben, dürfe kein Unterhaltsbeitrag zugesprochen werden. Sie sei nämlich "grundlos" ausgezogen. Diese Begründung ist nicht stichhaltig: Der Ehemann hat unbestritten selbst eine Freundin (auch wenn sie nicht bei ihm wohnt). Dann aber ist es der Ehefrau nicht zuzumuten, wieder nach Hause zurück zu kehren und unter einem Dach mit ihrem Gatten zu wohnen, der auch eine Drittbeziehung pflegt. Solches würde - entgegen den Behauptungen im Rekurs - offensichtlich auch ihre Persönlichkeit ernstlich gefährden (Art. 175 ZGB). Es wäre zudem "dem Wohl der Familie" (Art. 175 ZGB) bestimmt nicht zuträglich, wären doch ständige Streitereien vorprogrammiert. Sein Angebot, sie könne jederzeit in sein Haus zurückkehren, erweist sich damit als Scheinofferte: Es erfolgte nur, weil zum Voraus feststand, dass es sicher nicht angenommen wird. Zudem müssen die Belange der Kinder ohnehin geregelt werden, was eben im Rahmen eines Eheschutzprozesses zu geschehen hat. Als sachgemäss erweist sich daher einzig, den Parteien, die beide neue Partner haben, das Getrenntleben zu gestatten, dann aber der Ehefrau ein Aliment zu verweigern, weil sie in einer gefestigten eheähnlichen Beziehung lebt. * Obergericht Zivilkammer, ZKREK.2001.170 (Urteil vom 7.
