SOG 1974 Nr. 20 § 7 Ziff. 4 und § 24 Baugesetz.- Land ausserhalb der Bauzone ist in der Regel nicht in den Perimeter, der die Erschliessungskosten betrifft, einzubeziehen. Bei der Festsetzung von Grundeigentümerbeiträgen an die Erschliessung eines Quartiers (Strasse, Wasser, Kanalisation) wählte man einen Verteilungsschlüssel, der vor allem auf die Fläche der von der Erschliessung profitierenden Grundstücke abstellte. Zwei der Grundstücke werden von der Bauzonengrenze durchschnitten und zwar so, dass ein Teil von ihnen in der unüberbaubaren Landwirtschaftszone liegt. Im betreffenden Perimeterplan wurden nun diese beiden Grundstücke mit der vollen Fläche, also auch mit ihrem unüberbaubaren Teil, einbezogen. Die Grundeigentümer beanstandeten dies. - Das Verwaltungsgericht, als Beschwerdeinstanz, nahm dazu wie folgt Stellung: Das Land ausserhalb der Bauzone ist nicht in den Perimeterplan einzubeziehen. Das hat die Vorinstanz richtig erkannt. Für Land ausserhalb der Bauzone ist die bauliche Ausnützungsmöglichkeit gleich Null. Gewiss kann der Umstand, dass der in der Bauzone liegende Grundstücksteil erschlossenes Bauland wird, auch den anschliessenden Teil, der nun als Garten verwendet werden kann, aufwerten. Bei der schematischen Vorteilsanrechnung pflegt man indessen im Beitragsrecht von der baulichen Ausnützungsmöglichkeit auszugehen (je grösser die Ausnützungsziffer, desto grösser die bauliche Ausnützung; usw.). Der Einbezug von anschliessendem Gartenland mit Bauverbot in den Perimeterplan brächte deshalb grosse Unsicherheit mit sich. Wo wäre die Grenze zu ziehen für den Einbezug von Land ausserhalb der Bauzone? Solches anschliessendes Gartenland macht auch nicht die gleiche Werterhöhung mit wie der überbaubare Grundstücksteil. Eine saubere Lösung wird nur erreicht, wenn das Land ausserhalb der Bauzone unberücksichtigt bleibt. * Verwaltungsgericht, 20. September/4. Oktober 1974*
