Omnilex summary

The Administrative Court dealt with a complaint against the Forstdepartement concerning a special permit related to forest-distance requirements. It held that, under § 52 Abs. 2 GO, it may also review discretionary matters in this type of proceeding. However, in permit-granting cases it must generally respect a broad margin of appreciation of the permit authority, since that authority bears primary responsibility for a consistent exercise of discretion.

Omnilex headnote

§ 52 Abs. 2 GO; judicial review of discretionary permit decisions: where the Administrative Court is competent to review discretion in proceedings concerning the granting of permits, it must nevertheless accord the competent administrative authority a broad margin of appreciation. In permit cases, the primary responsibility for consistent discretionary practice lies with the permitting authority; the court's review is therefore restrained despite the existence of discretionary control (consid. unspecified).

* Verwaltungsgericht, Urteil vom 19. Key legal question

Extent of the Administrative Court's review of discretion in permit-granting cases under § 52 Abs. 2 GO

Extracted holding

Although § 52 Abs. 2 GO allows review of discretion in this proceeding, the court must grant the permit authority a broad margin of appreciation when reviewing permit decisions.

Extracted reasoning

In permit matters, the authority that bears primary responsibility for maintaining consistent discretionary practice must be allowed considerable leeway, even where the court may examine discretionary issues.
