Omnilex summary

The Zivilkammer of the Obergericht dealt with a husband’s nullity complaint in a maintenance case. The complaint attacked the assumption of a hypothetical income and a hypothetical rent when calculating support. The court held that the legal question whether such a hypothetical income may be attributed under Art. 163 ZGB is reviewable as a question of law. By contrast, the concrete amount of the imputed income and the housing costs are findings of fact and could be examined only for arbitrariness under § 305 Abs. 1 lit. b ZPO. Because the husband did not properly raise that ground, the challenged factual determinations were not reviewed.

Omnilex headnote

§ 305 Abs. 1 lit. b und c ZPO; Art. 145 ZGB; in maintenance proceedings, the distinction between the legal permissibility of imputing a hypothetical income and the factual assessment of its amount. Whether a hypothetical income may be taken into account for the calculation of maintenance is a question of law. The concrete quantification of that income, as well as the assessment of housing costs, concerns factual findings and is reviewable in nullity proceedings only for arbitrariness (consid. 1). A complaint that attacks merely the amount, without invoking arbitrary fact-finding, is inadmissible to that extent. The same differentiation applies to the imputation of a hypothetical rent (consid. 2).

* Obergericht Zivilkammer, Urteil vom 19. November 1998*

Key legal question

Whether the use of a hypothetical income for maintenance calculation is contrary to Art. 163 ZGB.

Extracted holding

The question is one of law and is reviewable in the nullity complaint.

Extracted reasoning

The court distinguished the legal question whether a hypothetical income may be attributed from the factual question of its concrete amount.

Key legal question

Whether the concrete amount of the hypothetical income could be reviewed in the nullity complaint.

Extracted holding

The concrete amount is a question of fact and can be reviewed only for arbitrariness; as it was not properly challenged, it was not examined.

Extracted reasoning

Maintenance is based on income and actual needs, which are factual findings. The complaint invoked only incorrect application of law, not arbitrary fact-finding under § 305 Abs. 1 lit. b ZPO.

Key legal question

Whether a hypothetical rent had to be included and in what amount.

Extracted holding

Only the legal principle of whether a hypothetical rent must be charged is reviewable; the concrete amount concerns facts and was not examinable.

Extracted reasoning

The same distinction applies to housing costs: the legal qualification is reviewable, the specific amount is a matter of fact.
