Omnilex summary

The appellant withdrew the appeal against provisional measures in a family case after the parties concluded an agreement on the ancillary effects of divorce. The Court of Appeal treated the withdrawal as desistance and struck the appeal from the docket. In view of the respondent's prior waiver of compensation and the parties' good-faith settlement efforts, the court decided that no court costs and no ripetibili would be charged.

Art. 352 cpv. 1 CPC; withdrawal of an appeal and its procedural consequences; Art. 148 cpv. 2 CPC; costs after desistance. premesso che __________ ha interposto appello il 1° novembre 1993 contro un decreto cautelare del 22 ottobre 1993 con cui il Segretario assessore della Pretura del Distretto di Lugano, sezione 6, ha disciplinato in luogo e vece del Pretore l’assetto provvisionale dei coniugi durante la causa di stato;

preso atto che il 7 giugno 1995 l’appellante ha dichiarato di ritirare il gravame, le parti avendo firmato nel frattempo una convenzione sugli effetti accessori del divorzio;

ricordato che il ritiro dell’appello equivale a desistenza (Rep 1978 pag. 375) e comporta, in linea di principio, l’addebito degli oneri processuali con obbligo di rifondere alla controparte una congrua indennità per ripetibili;

accertato che nella fattispecie l’appellata ha dichiarato previamente, il 2 giugno 1995, di rinunciare alla corresponsione di ripetibili ove il ricorso fosse stato ritirato;

considerato che appare giusto tenere conto della buona volontà dimostrata dalle parti nel risolvere in via amichevole ogni loro contenzioso e rinunciare pertanto in questa sede al prelievo di tasse e spese (art. 148 cpv. 2 CPC);

richiamato l’art. 352 cpv. 1 CPC,

decreta:

L’appello è stralciato dai ruoli per desistenza.

Non si riscuotono spese né si assegnano ripetibili.

Key legal question

Whether the appeal should be removed from the docket after the appellant's withdrawal.

Extracted holding

The appeal was stricken from the docket as withdrawn.

Extracted reasoning

Withdrawal of the appeal is treated as desistance; the court therefore removed the case from the roll.

Key legal question

How procedural costs and compensation should be allocated after the withdrawal.

Extracted holding

No court costs were charged and no party compensation was awarded.

Extracted reasoning

Although withdrawal would normally entail costs and compensation, the respondent had previously waived compensation and the parties showed good-faith efforts to settle amicably, justifying a waiver of fees and costs under the cited procedural rule.
