Omnilex summary

In a separation case before the Ticino Court of Appeal, the appellant withdrew the main appeal after the respondent had filed a cross-appeal. The court struck the main appeal from the docket as a desistment and held that the accessory cross-appeal became lapsed. It found no reason to depart from the ordinary rule on the costs consequences of withdrawal. Appellate costs were reduced because the case ended without a merits judgment, but all procedural costs were charged to the withdrawing appellant, who also had to pay CHF 3,000 in party compensation to the respondent.

Omnilex headnote

Art. 352 cpv. 1 CPC; withdrawal of the principal appeal and fate of the cross-appeal; a withdrawn appeal is treated as desistment and, as a rule, entails allocation of costs to the withdrawing party together with compensation to the opponent. A cross-appeal is accessory in nature and lapses when the main appeal is withdrawn; absent special reasons, the party withdrawing the principal appeal must also bear the pecuniary consequences of the cross-appeal’s caducity. Where the proceeding ends without a merits decision, the justice fee is to be reduced in fixing appellate costs (art. 21 LTG).

__________, __________ (patrocinata dall’avv. __________ __________, __________);

premesso che il 24 ottobre 1997 __________ __________ ha presentato appello contro la sentenza emessa il 3 ottobre 1997 dal Pretore del Distretto di Lugano, sezione 6;

constatato che il 2 dicembre 1997 __________ __________ ha a sua volta interposto appello adesivo contro la medesima sentenza;

preso atto che con lettera del 20 gennaio 1998 l’appellante ha comunicato di ritirare il ricorso;

ricordato che il ritiro di un appello equivale a desistenza (Rep. 1978 pag. 375) e comporta, in linea di principio, l’addebito degli oneri processuali a chi recede dalla lite, con obbligo di rifondere alla controparte una congrua indennità per ripetibili;

considerato che l’appello adesivo ha carattere accessorio e decade in caso di ritiro dell’azione principale (Anastasi, Il sistema dei mezzi di impugnazione del codice di procedura ticinese, Zurigo 1981, pag. 151; Poudret, Commentaire de l’OJF, Berna 1990, n. 2.7 ad art. 59 e 61), di modo che la parte che ritira l’appello principale deve, di massima, sopportare le conseguenze pecuniarie della caducità del ricorso adesivo (DTF 122 III 496 con riferimento);

rilevato che nel caso in esame non si intravede ragione per scostarsi da tale regola;

considerato che nella commisurazione delle ripetibili si deve tenere conto dell’impegno profuso dal legale dell’appellante adesiva per la preparazione e la redazione delle osservazioni all’appello e dell’appello adesivo;

ritenuto infine che la tassa di giustizia deve essere adeguatamente ridotta, la causa non terminando con un giudizio di merito (art. 21 LTG);

richiamato l’art. 352 cpv. 1 CPC,

decreta: 1. L’appello è stralciato dai ruoli per desistenza.

  1. L’appello adesivo è dichiarato caduco.

  2. Gli oneri processuali, consistenti in:

a) tassa di giustizia unica fr. 250.–

b) spese fr. 50.–

fr. 300.–

sono posti a carico di __________ __________, che rifonderà ad __________ __________ fr. 3’000.– complessivi per ripetibili di appello.

  1. Intimazione a:

– avv. __________ __________, __________;

– avv. __________ __________, __________.

Key legal question

Effect of withdrawal of the main appeal

Extracted holding

The main appeal was struck from the docket because the withdrawal is treated as a desistment.

Extracted reasoning

A withdrawn appeal is equivalent to desistment and normally leads to the costs being charged to the withdrawing party, with compensation to the other side.

Key legal question

Status of the cross-appeal after withdrawal of the main appeal

Extracted holding

The cross-appeal lapsed because it is accessory to the main appeal.

Extracted reasoning

The court applied the rule that a cross-appeal falls away if the principal appeal is withdrawn, and found no reason to depart from that rule.

Key legal question

Allocation of appellate costs and party compensation

Extracted holding

Costs were imposed on the withdrawing appellant, who must pay the respondent CHF 3,000 in appellate compensation.

Extracted reasoning

Since the appeal ended without a merits decision, the justice fee was reduced; the withdrawing party bears the procedural costs and must compensate the other side, taking into account counsel’s work on the response and cross-appeal.
