premesso che il 21 settembre 1998 __________ __________ ha introdotto appello contro la sentenza di divorzio emanata il 9 luglio 1998 dal Segretario assessore della Pretura del Distretto di Lugano, sezione 6;

preso atto che nel corso di un'udienza tenutasi il 3 dicembre 1999 davanti al Segretario assessore le parti hanno pattuito una modifica della convenzione sulle conseguenze accessorie in merito alle relazioni personali del padre con la figlia minorenne __________, accordo che è stato omologato dal Segretario assessore in calce al verbale di udienza;

constatato che l’attore ha dichiarato all’udienza di ritirare l’appello presentato il 21 settembre 1998;

ricordato che il ritiro di un appello equivale a desistenza (Rep. 1978 pag. 375), sicché per principio l'interessato va considerato soccombente;

accertato che le parti hanno concordato di compensare le ripetibili e di porre le spese dell'appello a carico della parte che le ha anticipate;

ritenuto, in ogni modo, che la tassa di giustizia deve essere adeguatamente ridotta (art. 21 LTG), anche per tenere conto della buona volontà dimostrata dalle parti;

richiamato l'art. 352 cpv. 1 CPC,

decreta: 1. La causa è stralciata dai ruoli per desistenza.

  1. Gli oneri processuali, consistenti in:

a) tassa di giustizia fr. 100.–

b) spese fr. 50.–

fr. 150.–

sono posti a carico dell'appellante. Le ripetibili sono compensate.
