Omnilex summary

The appellant withdrew the appeal against a provisional order authorizing the respondent to sell a parcel and use the proceeds to pay arrears. The Court of Appeal treated the withdrawal as desistance, struck the case from the docket, and charged the appellant with reduced court costs of CHF 150. It also compensated party costs, noting that the spouses had agreed on compensation in their settlement on ancillary divorce effects.

Omnilex headnote

Art. 352 CPC; withdrawal of appeal as desistance and procedural consequences. The withdrawal of an appeal is equivalent to desistance and normally leads to the appeal being removed from the docket. As a rule, the withdrawing party bears the procedural costs and must compensate the opposing party for its expenses; however, the court may reduce the court fee under Art. 21 LTG and, where the parties have agreed, offset party compensation. The allocation of costs follows the circumstances of the termination of proceedings (consid. not specified).
