richiamata la diffida 23 dicembre 1997 del Presidente di questa Camera mediante la quale all’appellante veniva assegnato un termine scadente il 9 gennaio 1998 per effettuare sul c.c.p. 69-10370-9 del Tribunale di appello un deposito di Fr. 120.-- a titolo di anticipo per le presunte spese giudiziarie, con la comminatoria che, nel caso di mancato versamento dell’importo entro il termine fissato, l’appello sarebbe stato dichiarato deserto ai sensi dell’art. 312 CPC;

constatato come il versamento non sia stato effettuato, per cui l’appello 17 dicembre 1997 della __________ va dichiarato irricevibile per mancato versamento dell’anticipo richiesto;

rilevato che di conseguenza va dichiarato il fallimento della __________;

ritenuto che per le peculiarità del caso si prescinde dal prelevare la tassa di giustizia;

per questi motivi,

richiamati gli art. 171 e 174 LEF

pronuncia:

  1. L’appellazione 17 dicembre 1997 della __________, è irricevibile;
