l’operato dell’CO 1, e meglio contro le comminatorie di fallimento emesse il 30 maggio 2006 nelle esecuzioni n° __________ e __________ promosse contro la ricorrente da

viste le osservazioni 12 giugno 2006 della procedente e 13 giugno 2006 dell’CO 1;

esaminati atti e documenti,

ritenuto in fatto e considerato in diritto:

che può essere formulato ricorso all'autorità di vigilanza contro la notifica della comminatoria di fallimento unicamente per ragioni formali (cfr. Jaeger/Walder/Kull/Kottmann, Bundesgesetz betreffend Schuldbetreibung und Konkurs, vol. II, Zurigo 1997/99, n. 3 ad art. 160; Ottomann, Basler Kommentar zum SchKG, vol. II, Basilea/Ginevra/Monaco 1998, n. 6 ad art. 160; Gilliéron, Commentaire de la LP, vol. III, Losanna 2001, n. 18 ad art. 160 LEF), ad esempio quando:

– l'escusso reputa di non essere soggetto all'esecuzione ordinaria di fallimento (art. 39 e 40 LEF);

– l'esecuzione è riferita a prestazioni fondate sul diritto pubblico (art. 43 LEF);

– è pendente azione di disconoscimento di debito conseguente a decisione di rigetto provvisorio dell'opposizione;

– la decisione (sommaria o di merito) che rigetta l'opposizione non è ancora esecutiva;

– l'escusso sostiene che la comminatoria di fallimento è stata emessa da un ufficio d'esecuzione territorialmente incompetente (DTF 118 III 6; 96 III 33 cons. 2);

che per questioni di merito la via del ricorso è invece preclusa;

che nel caso concreto la ricorrente allega unicamente censure di merito, ossia – in riassunto – che il prodotto fornito dalla procedente e per il quale chiede ora il pagamento non sarebbe stato da lei ordinato, non funzionerebbe e sarebbe inutile;

che siffatte censure non possono essere analizzate nell'ambito della procedura di ricorso ai sensi dell’art. 17 LEF dinanzi all'autorità di vigilanza per carenza di competenza materiale;

che per quanto attiene alla richiesta di concordato ai sensi dell’art. 293 LEF essa deve essere rivolta al giudice competente, ossia al Pretore di __________ (cfr. art. 14 cpv. 2 della legge cantonale di applicazione della legge federale sulla esecuzione e sul fallimento, LALEF, RL 3.5.1.1);

che in ogni caso un differimento del fallimento non è possibile prima della presentazione della domanda di moratoria concordataria e richiede una decisione del giudice del fallimento (cfr. art. 173a LEF);

che le comminatorie di fallimento in esame sono peraltro conformi§ alle norme di diritto esecutivo, in particolare per quanto riguarda l’iscrizione dell’escussa a registro di commercio e della reiezione – in via definitiva (art. 80 LEF) – delle opposizioni interposte dalla ricorrente;

che il ricorso va pertanto respinto;

che non si preleva la tassa di giustizia e non si assegnano indennità (art. 20a cpv. 1 primo periodo LEF, 61 cpv. 2 lett. a e 62 cpv. 2 OTLEF).

Richiamati gli art. 17, 20a, 166 LEF; 61, 62 OTLEF;

pronuncia:

  1. Il ricorso 2 giugno 2006 dell’RI 1, __________, è respinto.

  2. Non si prelevano spese e non si assegnano indennità.

  3. Contro questa decisione è dato ricorso entro dieci giorni alla Camera delle esecuzioni e dei fallimenti del Tribunale federale a Losanna, per il tramite della scrivente Camera di esecuzione e fallimenti del Tribunale di appello, in conformità dell'art. 19 LEF.
