Omnilex summary

The appellant challenged four AVS contribution decisions before the Ticino Social Insurance Court. While the appeal was pending, the AVS fund issued new decisions on 18 November 1999 accepting the appellant’s conclusions and annulling two of the challenged decisions. The appellant also withdrew the appeal. The single judge held that, under the applicable cantonal procedural rule, the administrative authority could reconsider the contested decision before filing its response; the case had therefore become moot and was struck from the docket. No court fees or expenses were charged, and the fund had to pay CHF 400 in party compensation.

Omnilex headnote

Art. 3/a cpv. 1 of the cantonal procedural law on appeals to the Social Insurance Court; reconsideration by the administrative authority and mootness of the appeal. Before the submission of its response, the administrative authority may reconsider the contested decision ex officio. If, as a result of such reconsideration, the challenged decision is replaced or the appellant’s requests are accepted, the appeal loses its object and is to be removed from the roll. In such a situation, the court may order no fees, while granting party compensation according to the outcome and procedural conduct (consid. relevant).

Key legal question

Whether the appeal should be struck out as moot after the respondent reconsidered its decision and the appellant withdrew the appeal.

Extracted holding

The appeal had become devoid of object and was struck from the docket.

Extracted reasoning

Before the response was sent, the administrative authority could reconsider the challenged decision; after the new decisions of 18 November 1999 accepted the appeal conclusions and annulled two challenged decisions, no live dispute remained.

Key legal question

Whether court fees and costs should be charged, and whether party compensation was due.

Extracted holding

No court fees or costs were charged, and the respondent had to pay the appellant CHF 400 in party compensation.

Extracted reasoning

Because the appeal was struck out due to mootness following the respondent's reconsideration, the court ordered no fees or expenses and awarded compensation to the appellant.
