Omnilex summary

The appellant challenged a family-allowance decision by the cantonal compensation fund. Before submitting its response, the fund issued a new decision on 14 December 1999 fully accepting the appeal and annulling the contested decision. The single judge of the Ticino Social Insurance Court held that, under the cantonal procedural rule allowing reconsideration before the response is filed, the matter had become moot. The appeal was therefore removed from the docket, with no court fees or costs, and the fund was ordered to pay CHF 300 in party compensation.

In such a situation, no court fees or costs are charged; party compensation may nevertheless be awarded to the appellant according to the outcome of the reconsideration.

Key legal question

Whether the appeal remained pending after the authority reconsidered and replaced the challenged decision before filing its response.

Extracted holding

The appeal had become moot because the administrative authority issued a new decision fully accepting the appeal's requests and annulling the contested decision.

Extracted reasoning

Under Art. 3a para. 1 of the cantonal procedure act for social-insurance appeals, the authority may reconsider the contested decision before sending its response; once it did so, there was no longer a live controversy.

Key legal question

Allocation of costs and party compensation after the case became moot.

Extracted holding

No court fees or costs were charged; the compensation fund had to pay the appellant CHF 300 as party compensation.

Extracted reasoning

Because the case was removed from the docket following mootness, the court ordered no fees or costs and awarded limited indemnity to the appellant.
