in materia di assicurazione contro le malattie

  1. __________, assicurata contro le malattie presso la __________, con ricorso 15 aprile 1999 ha adito lo scrivente TCA chiedendo la condanna della __________ all'assunzione

delle spese sostenute durante la gravidanza ed il parto

di tutti gli oneri legati alla succitata degenza per parto

a procedere con sollecitudine al versamento di quanto richiesto

ad assumere tutte le ulteriori spese inerenti il mancato pagamento delle fatture mediche." (I)

Con pronuncia 26.5.1999, il TCA, considerato che la cassa convenuta non aveva ancora emanato una decisione in merito alle richieste ricorsuali e che l'art 86 cpv. 2 LAMal non poteva trovare applicazione, ha dichiarato irricevibile il ricorso ed ha rinviato gli atti alla __________ affinché procedesse nell'ambito delle sue competenze.

  2. Con atto 23 agosto 1999 la __________ ha comunicato al TCA quanto segue:

" la richiesta del 26 maggio 1999, con la quale la STCA ci chiedeva di rilasciare una decisione formale, è stata effettuata già in data 25 maggio 1999. La decisione che noi abbiamo inviato alla signora __________, non essendoci pervenuta una sua opposizione, si può ritenere cresciuta in giudicato e l'intero incarto si può chiudere."

  1. Così come impone il dualismo introdotto dalla LAMal fra assicurazione sociale delle cure medico-sanitarie e assicurazioni ad essa complementari, il ricorso interposto da __________ è stato interpretato anche quale petizione (art 75 LCAMal) e come tale intimato alla __________ per risposta.

La __________ ha comunicato quanto segue:

" …La informiamo che la causa si basava unicamente su prestazioni LAMal e non su assicurazioni complementari.

Si può pertanto chiudere il caso." (IV).

  1. Tutto ciò considerato, dunque, si deve ritenere che la lite di cui all'incarto 36.99.79 è senza oggetto.

Pertanto, richiamati gli art 23 LPTCA e 351 e seg CPC

dichiara e pronuncia

1.- La causa é stralciata dai ruoli.

2.- Non si percepisce tassa di giustizia, mentre le spese sono poste a carico dello Stato.

3.- Intimazione alle parti.
